ATTORNEY APPEALS BRITNEY SPEARS’ CONSERVATORSHIP

An attorney who claims to represent Britney Spears filed an appeal on Tuesday in L.A. Superior Court, seeking to overturn several of the court's earlier orders.

Jon Eardley states in court papers first obtained by CelebTV.com that he is appealing a Feb. 1 ruling that established the convervationship over "the person and the estate of Britney Spears."

He is also appealing a March ruling that awarded a $2,500-a-week allowance to Britney's father and co-conservator, Jamie Spears, according to court documents.

Claiming that a March 3 hearing in Spears' case was "conducted in secrecy and without notice to counsel," Eardley is asking the court to revisit the conservatorship issue.

While Eardley is holding tight to the position that he represents Spears, a federal judge ruled last month that Britney was not fit to choose her own counsel.

"Mr. Eardley fails to explain why he can bring this claim for her in the first instance. He cannot," Judge Philip Gutierrez wrote in a three-page ruling.

"Mr. Eardley had no authority to remove the case from state court. He is neither a party nor a defendant. While he claims to be Ms. Spears's attorney, the probate court...found that she was incapable of retaining her own counsel."

In other words, a judge determined that Britney Spears was never in a position to hire her own attorney in the conservatorship case.
